General Terms and Conditions

Article 1 – General Terms and Conditions
1.1 These general terms and conditions apply to every offer made by Grow Ecom and to every agreement concluded between Grow Ecom and the consumer. They can be accessed and saved at: https://softload.fr/general-terms-and-conditions/.
1.2 If any provision is found to be void or invalid, the remaining provisions shall remain fully applicable.

Article 2 – The Purchase Contract
2.1 Product listings on Grow Ecom include clear and accurate descriptions of the digital products offered. Obvious mistakes do not bind Grow Ecom.
2.2 Grow Ecom acts as a reseller, not the publisher or creator of digital products. Product conditions are defined by the original provider.
2.3 A purchase contract is concluded once the customer confirms via the “Order & Pay” button and the payment is received.
2.4 Upon confirmation of payment, digital product delivery is immediate.

Article 3 – Exclusion of the Right of Withdrawal
3.1 All purchases concern digital content not delivered on a physical medium. Due to their nature, these products are excluded from the right of withdrawal.
3.2 Before finalizing the order, the consumer must explicitly agree to waive their right of withdrawal and authorize immediate delivery.

Article 4 – Price
4.1 The displayed product price is shown in the shopping cart.
4.2 VAT, transaction fees, and service charges may appear separately on the checkout page.
4.3 Prices may fluctuate due to market dynamics and are subject to change.

Article 5 – Delivery
5.1 Delivery is done via email. The customer must provide and verify a valid email address. Grow Ecom is not responsible for incorrect information.
5.2 For PayPal purchases, products are sent to the PayPal email. Grow Ecom is not liable if that address is inaccessible.
5.3 Region-specific products require accurate selection; mistakes are the customer’s responsibility. Returns are not accepted.
5.4 In the event of a defect, the consumer must cooperate with Grow Ecom’s support to identify and resolve the issue.
5.5 Grow Ecom may send payment reminders or notifications related to your order by email or other means.

Article 6 – Fraud and Compliance
6.1 Grow Ecom implements anti-fraud measures in line with AML regulations and PSD2. Customers must comply.
6.2 In cases of suspected fraud, Grow Ecom may cancel orders, request verification documents, delay delivery or refunds, report incidents, or seek reimbursement for losses.

Article 7 – Warranty
7.1 Digital products comply with the offer description and applicable regulations.
7.2 Product lifespan is determined by the publisher. Pre-activated or discounted products may have a shorter remaining lifespan. This is not a defect.
7.3 Product terms may not always be provided by Grow Ecom. The customer is responsible for reviewing these via the publisher’s site.

Article 8 – Force Majeure
8.1 Grow Ecom is not liable for delays or non-performance due to circumstances beyond its control.
8.2 In case of force majeure, obligations may be suspended.
8.3 If delivery becomes impossible, the customer may terminate the contract. Refunds can only be made to SEPA or PayPal accounts.

Article 9 – Liability
9.1 Grow Ecom is not liable for losses from fraud, misuse, incorrect use, or external service failure.
9.2 Liability is limited to direct losses up to the value of the product. Indirect damages are excluded.
9.3 Any liability is limited to the amount covered by insurance.
9.4 Refunds or replacements are only issued if the product is confirmed as defective.
9.5 Limitations do not apply in cases of gross negligence or willful misconduct.

Article 10 – Complaints
10.1 Complaints must be submitted with a clear explanation.
10.2 Grow Ecom responds within 14 days. If more time is needed, an update will be sent within that period.
10.3 Grow Ecom aims for fair resolution of all complaints.

Article 11 – Loyalty Points (Grow Coins)
11.1 Customers earn Grow Coins on eligible purchases.
11.2 Grow Coins can be used for future purchases. They are not reversible or redeemable for cash.
11.3 Grow Coins are non-transferable and expire 12 months after the last order.

Article 12 – Legal Jurisdiction
12.1 These terms are governed by French law.
12.2 Disputes shall be resolved by the competent courts in France, unless otherwise specified.

Article 13 – Voucher Validity
13.1 All vouchers issued by Grow Ecom are valid for 12 months from the date of purchase.
13.2 Expired vouchers are not refundable or exchangeable.
13.3 Legal rules for voucher validity are based on French consumer law.
13.4 Extensions or refunds of expired vouchers are only possible by legal exception.

Article 14 – Security and Risk Management
14.1 Vouchers are tracked in a secure system to minimize financial risk and ensure traceability.
14.2 After 12 months, expired vouchers are void.
14.3 Grow Ecom maintains full accounting of unredeemed vouchers.
14.4 Anti-fraud measures include transaction monitoring and audits.
14.5 Grow Ecom may restrict redemption or sales to manage risk.
14.6 If regulations change, processes will be updated and customers notified accordingly.
